Where it applies

Written for the jurisdictions listed here.

The full exemption for a veteran rated 100% permanent and total, or permanently unemployable, is granted by the State Department of Assessments and Taxation under Tax-Property Article section 7-208 and is a State entry. Calvert County Ordinance 34-18 of 2018, County Code sections 136-53 and 136-54, sets out how the county pays back county tax already paid. The county grants a refund of the county portion of the tax paid on the veteran's principal residence back through the date VA made its disability determination, and the refund may be retroactive. The applicant has to meet the qualifications and limits of section 7-208, which makes the refund mandatory for each year the exemption was authorized but not granted when the veteran applies within the three-year window that starts with the calendar year of first eligibility. Unlike several other counties' codes, Calvert's adds no shorter look-back of its own. To claim it, give the County Treasurer a copy of the SDAT application for the disabled veteran exemption, or for the surviving spouse exemption, approved by SDAT and VA. The Treasurer's Office is at 410-535-1600 or 301-855-1243, extension 2277. Calvert County has adopted none of the local veteran property tax credits in Title 9. State law lets it give a credit to American Legion Calvert Post No. 85 under section 9-306(e), but the county's code and its list of credits show none.

Thresholds

Thresholds for Calvert County Refund Under the Disabled Veteran Exemption
GateRule
100% permanent and totalThe refund follows the state exemption, which SDAT grants on a 100% permanent and total rating or a finding of permanent unemployability. One path is a VA rating of 100% that is service-connected, permanent, and total.
Permanent and total on the 100% pathThe 100% rating has to be permanent and total. A 100% rating VA has not made permanent does not meet this path.
Permanently unemployableThe other path is a finding that the veteran is permanently unemployable. The assessment application treats that as 100% permanently unemployable.
Permanent on the unemployability pathUnemployability qualifies on this path when VA has found it permanent.
