Burleigh County Tax Equalization: Disabled Veteran Property Tax Credit intake

Burleigh County takes the state disabled veteran property tax credit application through Tax Equalization, whose director signs the approval block, and the commission approves the credits year round as routine abatement items.

Also called: property tax, 57-02-08.8, Tax Equalization, Allan Vietmeier, abatement, SFN 24770, April 1, Bismarck.

For: Veteran or service member, survivor.

Where it applies

Written for the jurisdictions listed here.

The credit is the State's, under Section 57-02-08.8, as the North Dakota entry explains: the disability percentage applied against the first nine thousand dollars of taxable valuation of the homestead. In Burleigh County the application is handled by the Tax Equalization office, Director Allan Vietmeier, (701) 222-6693, at 221 N 5th Street, P.O. Box 5518, Bismarck ND 58506. The county's page lists the Disabled Veteran Credit under its credits with the eligibility in one line - an honorable discharge or retirement, and a VA certification of disability at 50 percent or greater - and links the Tax Commissioner's application. That form, SFN 24770, says the application "must be filed with the county auditor by April 1 of the first year for which the credit is claimed", and its approval block is "to be completed by Assessor or Director of Tax Equalization". First-time filers file the affidavit, a property description, a DD Form 214 copy and a VA certificate of the disability percentage; those documents are confidential under Section 37-18-11 per the Tax Commissioner's guideline, though the statute itself says the affidavit and certificate "must be open for public inspection", a conflict worth knowing before filing. The commission's part. The board approves disabled-veteran credits as recurring consent items on its abatement lists through 2025 and 2026 - individual parcels reduced by the veteran's percentage - so a veteran whose application stalls can point at the commission's own monthly practice. The county also carries the related paraplegic veterans exemption for VA adaptive housing, which does not require the disability to be service-connected, under the same office. A veteran who never applied for earlier years can ask the commission, under Section 57-02-08.8(7), to cancel the unpaid taxes representing the credit for those years.

Thresholds

GateRule
The credit follows the state gate: 50 percent or more, or the unemployability routeSection 57-02-08.8 requires a service-connected disability of fifty percent or greater, or an extra-schedular rating to include individual unemployability paid at the one hundred percent rate. The county intake applies the state rule.
Individual unemployability qualifies on the statuteThe statute names "an extra-schedular rating to include individual unemployability which results in the veteran being paid at the one hundred percent rate" as an independent route, so a veteran below fifty percent schedular paid at the total rate qualifies.
