Bedford County Vehicle Tax Exemption for Veterans With Limb Loss, Blindness, or Permanent and Total Disability
Bedford County’s code exempts outright one vehicle, owned or leased, of a veteran with limb loss, blindness, or a permanent and total service-connected disability certified by the Department of Veterans Services. Limb loss or blindness qualifies at any rating. The county’s page and form describe only the 100% exemption.
Also called: car tax, personal property, vehicle tax, amputee, blind, Bedford car tax.
Section 17-25 of the Bedford County Code puts the class in Code of Virginia section 58.1-3506(A)(19) at a full exemption rather than a reduced rate. One motor vehicle owned by a qualifying disabled veteran, or leased by the veteran where the lease makes the veteran pay the tax, and regularly used by the veteran, "shall be exempt". The section defines the veteran as the statute does, as alternatives: a veteran who has "lost, or lost the use of, one or both legs, or an arm or a hand, or who is blind or who is permanently and totally disabled as certified by the Department of Veterans Services". Limb loss or blindness qualifies on its own at any rating. The veteran gives the Commissioner of the Revenue the Department of Veterans Services certification and a personal certification, with the vehicle identification number, that he or she regularly used the vehicle the year before. Subsection (c) calls that DVS document "a certification of total disability", which reads narrower than subsection (b); the statute asks only for a DVS statement that the veteran is in the class and that the disability is service-connected.
None of this is on the county's pages. The real estate tax page and the "Personal Property Tax Relief for Disabled Veterans" form describe only the statewide exemption in section 58.1-3668 for a veteran rated 100% service-connected, permanent, and total. A veteran with an amputation or blindness rated below 100% should ask for the section 17-25 exemption by name.
The form for the 100% exemption also says the vehicle "must be owned by the veteran or jointly owned with spouse", and the page says it applies to "one vehicle titled to the 100%, service-connected, disabled veteran". Section 58.1-3668(B) covers a vehicle "owned and used primarily by or for" the veteran and lets a vehicle owned by a married person qualify "if either spouse is a veteran" rated 100%, so a car titled only to the spouse and used for the veteran also qualifies. The 100% exemption ends at the veteran's death, as the page says.
