Albemarle County Disabled Veteran and Surviving Spouse Real Estate Exemptions, Ten Acres

Albemarle’s county code applies the statewide exemptions for a veteran rated 100% service-connected, permanent, and total, and for the surviving spouse of a service member who died in the line of duty, to the dwelling and up to ten acres.

Also called: property tax, real estate tax, Albemarle property tax, 100% disabled, ten acres, Gold Star spouse.

For: Veteran or service member, survivor.

Where it applies

Written for the jurisdictions listed here.

Section 15-704 of the Albemarle County Code applies the two statewide real estate exemptions, for a disabled veteran under Code of Virginia section 58.1-3219.5 and for the surviving spouse of a member of the armed forces under section 58.1-3219.9, to the qualifying dwelling and "the land, not exceeding ten acres, upon which a qualifying dwelling is situated". The statewide baseline is one acre, so the county's ten acres is the local difference. In every other respect the section adopts the state articles by reference. The section's title still says "killed in action", but because it applies Article 2.4 as the state amends it, the exemption follows the current statute, which since January 1, 2025 covers any member who died in the line of duty with a Department of Defense Line of Duty determination. The line-of-duty spouse exemption is capped at the county's average assessed value of a single-family dwelling. The county's own finance pages were not reachable for this entry: albemarle.org returned an Access Denied page to every automated request on September 30, 2026. This entry rests on the county code, and application details, forms, and deadlines should be taken from the county's Real Estate office.

GateRule
100% permanent and totalAlbemarle applies the statewide exemption to the dwelling and up to ten acres. The same ten acres apply to the line-of-duty surviving spouse exemption. One path is a VA rating of 100% that is service-connected, permanent, and total.
Permanent and total on the 100% pathThe 100% rating has to be permanent and total. A 100% rating VA has not made permanent does not meet this path.
Individual unemployabilityThe other path is a total disability rating based on individual unemployability that VA has also rated permanent and total.
Permanent and total on the unemployability pathIndividual unemployability qualifies on this path only when VA has rated the disability permanent and total.
Or a line-of-duty surviving spouse, with no ratingThe surviving spouse of a member of the armed forces who died in the line of duty qualifies under section 58.1-3219.9 without any disability rating, on the same ten acres.
